Court Terminology 101

 Q1: What is meaning of Dasti?

A1: Dasti means (taken/received)"by hand"


Q2: What is Dasti order?

A2: Any order passed by the court is signed by the judge. If you request judge to provide dasti copy of the order and it is recorded in the order sheet, additional copy of order is printed for you and given by the reader by writing DASTI at top. One copy goes into your case file. You can collect this order from the reader as soon as it signed by the judge. Otherwise, the other option is to apply for certified copy of the order and wait a lifetime. (Note the use of word reader. Don't bother the steno. Although steno can check if Dasti is written in your order sheet or not as Steno is the one who will type it.)


Q3: What is Jimni order?

A3: Jimni order is the record of proceedings on each day. I think it is just used to distinguish an order passed against an application from the regular order where just actual events are recorded like "Appeared and sought adjournment". I have heard this term from SIF-Chandigarh group and not sure if it is used in Delhi as well. I was told that you can request jimni order copy from reader but I have never tried this.


Q4: What is Dasti summons?

A4: Summons is a single page printed by the court which all of us have received for our cases. These summons are sent by the court in the background. We can request court to allow Dasti summons if party  refused to accept summons in the past, is not appearing despite delivery of summons sent by the court or the court is not able to deliver summons. Basically, we tell court that you failed to deliver summons, now let me do it.

Dasti summons just means that the single-page of summons is handed over to us by the Alhmad. We have to attach our application with it, go to process server and take him with us to the address of opposite party. He will get the summons signed in our presence if OP is available and in case of outstation, he will give us the signed summons and in case of local, he will send those directly to the court.


Q5: What is the difference between reader and steno and Alhmad?

A5: Reader "stands" next to judge, hands over files to judge for each case, receives applications, calls parties, handles case dates etc. Reader acts as additional hands of the judge and handles all petty matters standing next to the judge.  

Steno is the typist who acts as typewriter for the judge and sits below the judge. Steno is not supposed to have any contact with external world. Steno is just the fingers of judge on keyboard. Judge relies on steno for templates and just fill the case-specific details in most of the cases. Only in case of a full-fledged judgment, which is rare occurrence, the judge steps outside the world of templates. 

Alhmad sits in separate record room. Every court has an associate room where all case files are kept and the Alhmad is responsible for finding file corresponding to case number.


6. Speed post Vs regd post

Regd post is for an addressee and speed post is for an address. Regd post is preferable when sending legal documents. You can also attach an Acknowledgement Due slip with it so that you have proof of delivery.

7. Is dasti summons always by hand?

Sometimes crazy and corrupt court staff may ask you to send dasti summons without any attempt by the court. The question is can you send dasti summons by registered post?
