SUBJECT - Application under section 6(1) and 6(3) of RTI Act 2005

Respected Sir,

Kindly provide below requested information under RTI Act 2005.

Note: Please provide yearwise information for all data below for the last 10 years or the maximum data available with you separately for each police station. If this data is already available publicly, you may please point me to it, and I will read the data from the public link.

 

1.       Please give yearwise count of FIRs registered under 498A in each police station in Delhi for last 10 years? Please provide this data in tabular form for each police station where the first column is year, second column is count of FIRs registered under 498A in that year.

2.       Please give yearwise count of FIR registered under both 498A + 406 in each police station in Delhi for last 10 years? You may add additional column to table of 1 or provide in same tabular format separately for each police station.

3.       Please give yearwise count of cases/FIRs registered under 498A which are closed because police investigation found that "case was maliciously false"? You may add additional column to table of 1 or provide in same tabular format separately for each police station.

4.       Please give yearwise count of cases/FIRs registered under 498A (in specific year or previous years) for which chargesheet under CrPC is submitted to the court? The year in the row is the year in which chargesheet is submitted. You may add additional column to table of 1 or provide in same tabular format separately for each police station.

5.       Please give yearwise count of cases/FIRs registered under 498A (in specific year or previous years) which are closed in specific year without filing of chargesheet in court? Please provide the data for the last 10 years and separately for each police station. The year in the row is the year in which case is closed.

6.       Out of the year wise counts in reply to 5 i.e., 498A cases closed in a specific year without filing chargesheet/charges against the accused, please give yearwise count of cases where the closure happened in specific year because police investigation found that "no offence has been committed"? You may add additional column to table of 5 or provide in same tabular format separately for each police station.

7.       Out of the year wise counts in reply to 5 i.e., 498A cases closed in a particular year without filing chargesheet/charges against the accused, please give yearwise count of cases where the closure happened in specific year because police investigation found that "only a non-cognizable offence has been committed or being of a civil nature"? You may add additional column to table of 5 or provide in same tabular format separately for each police station.

8.       Out of the year wise counts in reply to 5 i.e. 498A cases closed in a particular year without filing chargesheet/charges against the accused, please give yearwise count of cases where the closure happened in specific year because police investigation found that "not sufficient grounds to investigate or there is not SUFFICIENT EVIDENCE to justify sending anyone for trial, or in which the offender is not known or cannot be arrested and sent for trial."? You may add additional column to table of 5 or provide in same tabular format separately for each police station.

9.       Please give yearwise count of cases/FIRs meeting all three conditions - registered under 498A (in specific year or previous years) AND which is subsequently found to be false (in specific year or previous years) AND where a counter case u/s 182 IPC is initiated against the complainant in specific year by the police? You may add additional column to table of 1 or provide in same tabular format separately for each police station.

10.   Please give yearwise count of convictions under 498A/406 by the lower court and the count of acquittals under 498A/406 by the lower court (the case may be filed anytime in past but judgment is given in specific year)? Please provide this data for last 20 years. This data will provide information on the acquittal rate per year. In each row, say judgment is passed for 100 accused in an year, out of which 95 people are convicted and 5 are acquitted, then acquittal rate will be 5%, conviction rate will be 95%.

Ad-interim vs interim orders (Order 39 Rules 1 & 2 CPC)

  Rule 1 or Rule 2 of Order 39 are repository of the power to grant injunction.  An order of injunction is always passed under Rule 1 or Rule 2 Order 39 save and except rare orders passed under Section 151 of the Code of Civil Procedure.  Rule 1 and Rule 2 of Order 39 do not use the words "interim or ad interim".
