Commentary on landmark judgment from Allahabad HC in Mukesh Bansal vs State of UP

UPDATE: This case then went to SC. Sr advs like Vikas Singh and Sid Luthra were fielded by beach. SC let her off with mere apology when her UPSC selection should have been cancelled. A woman without character is curse to civil services.

Recently, there was a landmark judgment by Allahabad HC on the misuse of 498A and proposal of setting up of FWC. The judgment was passed on 13th June 2022. Judgment link , media coverage 1, coverage 2 and involved discharge of boy's parents from 307, 498A, dp act etc.

I do not know about the background of the boy but the girl is a Bcom (hons) graduate from the most reputed college for bcom in India, namely, SRCC - New Delhi. For those who don't know, the cutoff for bcom(hons) course is usually about 100% for general category students which means this girl scored 100% marks in 4 subjects in her +2. She should be an exceptionally bright and hardworking student and as a SRCC graduate, finding a high paying job should be a cakewalk. Yet, her parents chose to marry her immediately after the graduation. Most likely, they found a golden egg laying husband, so it can be assumed that the boy should be from a rich background. The case says that due to harassment from the girl, the boy's parents had to leave their home and live on rented accommodation, so I may be wrong about boy being rich.

Anyhow, I was reading through the judgment and like the judge, I was appalled at the exaggerated lies by the girl to destroy the boy's family. What I found even more shocking is that this girl was trying out UPSC since 2019 and managed to clear in her third attempt in 2021. The final results were declared just on 30th May 2022 and she has managed to secure 177th Rank. It does not come as a surprise as someone who can score 100% in +2 can clear UPSC as both involves lot of mugging and long hours of focused study without taking anything away from the hardwork and merit of the candidate. What is disappointing is that a person who will be at a very senior post as an IAS or IPS or equivalent post is found to be lying by the Hon'ble High court after going through lot of details. This person had no shame to cry about domestic abuse while appearing in newspaper interviews (spare the thought for the suffering and mental trauma that a potentially innocent person can be going through... hey feminists, don't argue on innocent until proven guilty). 

Can the future of India ever be safe with such people? This boy was kept in jail for about 3.5 months. also, Ref. https://indiankanoon.org/doc/99226856/ .
The girl has done done everything that she could do. She has secured 100% in registering fir with full preparation. Double mlc, making sure doctor writes about her injuries and attack on her by husband, no delay in reporting to police, double police report, independent witnesses etc. The court finally ripped through the web of her lies to reach the truth.
How are we ever going to compensate for the suffering of the boy and his family if this girl is found to be lying. The Hon'ble Allahabad HC has already mentioned about several of her lies in the judgment and the presumption is strongly in favor of boy at this point. 

Prima facie, it looks as if she has got her appointment by playing fraud with the UPSC interview panel and generating misplaced sympathy by telling fake stories of domestic abuse. Should her appointment not be challenged in the court and with relevant authorities? Why not? The parents of the boy and the boy himself without waiting for the acquittal should also file defamation against her and seek injunction for appearing in media.

India can never be safe in the hands of such people and the threat is far too real and huge. Hope things improve for the boy with the time and god give him strength to get through this.

Ad-interim vs interim orders (Order 39 Rules 1 & 2 CPC)
